Reader’s Question:

Will a case of DUI that was dismissed in court can still affect my record and thus my insurance?

Neil

Thank you for asking Neil.

It is possible that for a dismissed DUI case to affect your driving record still. I would suggest that you check with your state’s Department of Motor Vehicles to find out what exactly will be listed on your driving record. The cost of a SR-22 will depend upon your driving history and other personal information.

The Department of Motor Vehicle (DMV) will be able to give you more information if a dismissed case of DUI will still show up your your driving record. You may also contact your insurance company to know if this will affect your auto insurance.

Reader’s Question:

My license was suspended because of the DUI and my parents want to add me to their policy. Will the company be able to know if about the DUI?

John

Thank you for asking John.

I would suggest that you let the insurance company and your parents know that your driver’s license is suspended because of the DUI. You should not operate a vehicle or be insured on their insurance policy with a suspended or revoked license. You could put your parents or their car insurance policy at risk for non-disclosure.

The insurance company can pull up your driving history when they try to add you to the insurance policy. They can disclose the information that they are cannot add you because of your your license is suspended because of DUI. They can provide the inquirer for the information to use in order to contact the reporting agency.

Reader’s Question:

Is there an insurance company that I can check online that does not consider tickets like DUI in order to provide insurance premiums?

Vince

Thank you for asking Vince.

Some auto insurance companies will not quote you higher rates, or raise your rates if you already have an insurance policy in active, for certain moving offenses in general all car insurance providers take into consideration an individual’s driving record as a rating factor.

The drivers’ record and motor vehicle record (MVR) is used to determine what type of risk as a motorist they are and so the risk that they are putting the insurance carrier under to insure them and the vehicle they drive. Traffic violations such as DUI and DWI on a driver’s MVR shows that the person may drive recklessly or poorly.

There are some insurance companies that will not raise your rates if it is your first minor ticket however your safe driver discount will likely be removed which will cause your car insurance premiums to go up. You may check online and get a quote from these insurance companies to get the specific information you need regarding insurance rates.

Reader’s Question:

Will my DUI still be in my Texas record after 20 years?

Frances

Thank you for asking Frances.

The answer is yes.

This driving under the influence (DUI) or Driving While Intoxicated (DWI) will still be on your Texas driving record because these types of serious convictions stay on your TX driving record indefinitely.

The Texas Department of Public Safety states that moving infractions appear on a driving record for a period of 5 years with the exception of major offenses. Some examples of serious violations are DWI, DUI, Driving without insurance which will remain on a Texas driving record for life.

Reader’s Question:

Is it possible that my insurance company will cover the total loss and damages in my car if I was convicted of DUI?

Rain

Thank you for asking Rain.

It is not a typical exclusion in an auto policy being convicted of a DUI. Yes, the coverage should be afforded to the terms in your policy. Claims regarding an accident that took place while you were driving under the influence (DUI) are normally covered by the insurance coverage you had in place at the time of the accident.

Some states have alcohol exclusions, but this is normally in regards to damages one sustains while driving drunk.

To make sure that your insurance provider will accept your claim for the car that was damaged at the time you were cited for a DUI, you should review through the terms and conditions of your insurance policy and speak with your insurance agent. Your insurance company should be able to advise you if there are any exclusions in your insurance policy that would allow your them to deny your claim.

Reader’s Question:

My friend drove my car and received a DUI. Will my insurance rate go up because she used my car?

Tara

Thank you for asking Tara.

If the citation or ticket is written to a driver only and not against a the car the person is driving, typically , it is the driver’s record that will be affected. Since your friend received the ticket for DUI in his or her name only then it would usually be their license and their insurance rates that would be affected by this citation.

You may verify with your state’s Department of Motor Vehicle to get more information regarding your specific situation.

Reader’s Question:

I will be losing my license because of the DUI conviction. Can I have my new car insured while my license is suspended so others may be able to use it?

Nina

Thank you for asking Nina.

I dont think it is possible (or may be difficult) to carry auto insurance while your license is suspended. Once an insurance carrier finds out that your license is suspended, your insurance policy typically is canceled.

If there is another person that has registered or co-owns the new vehicle with you, she/he might be able to get insurance in their name for the car until your driver’s license is reinstated. If not then the finance company can get “force” insurance, in which they take out insurance on the car to protect their asset (the car) but it might not be enough for the coverage of others operating the vehicle.

If you are able to get a restricted driver’s license, while still serving your penalty for the DUI, then an insurance carrier will normally be able to insure you and your car.

Reader’s Question:

What will happen now if I received a ticket for speeding and driving without insurance?

Tom

Thank you for asking Tom.

State laws and jurisdiction varies so obviously we will not be able to provide the exact cost that you may incur with this.

You still have a driving record even though you do not have a drivers license . These moving violations will show on your driving record. Each insurance provider has their own rating system and point values that are assigned for each type of violation or claim. Most minor violations count as two (2) points, for major violations count as three (3) points and serious violations like driving under the influence (DUI) or driving while intoxicated (DWI) may count as high as six (6) points. This is will not always be the case, because there are many factors that go into generating your insurance rate.

You will be required to pay the penalty to the state for the violation and your insurance costs may increase because of the added points on you driving record. You can get more information about your specific state laws and infractions by visiting your state’s Department of Motor Vehicle website.

Reader’s Question:

I received a DUI but I dont want to lose my license, so I just want to know if there is a US state where I can get a license?

Noreen

Thank you for asking Noreen.

All states have laws regarding driving while drinking or driving under the influence (DUI) of alcohol and other serious offense. In all states a DUI is a serious offense with associated penalties such as jail time, fines, suspension of driver’s license, etc. Most of these states are also part of the Driver’s License Agreement which means that they forward their DMV records with each other so the DUI charge would follow you if you move to another state.

There are some states which allow offenders to operate their vehicles that are equipped with ignition interlocks. This device checks the driver’s breath and will disable the ignition if it determines the motorist has been drinking. I would suggest that you get legal advice regarding this to check if there is anyway in which you could not lose your license.

DUI insurance rate

Reader’s Question:

I want to know if my insurance rate will go up if I add my mother which has a DUI conviction? We live in the same house.

Chris

Thank you for asking Chris.

It is possible that your insurance rates may increase after you add your mother to your insurance policy. Even considering the fact that each of you have your own insurance policy, the insurance provider will take into account all of the drivers/motorist ,in this case, you and your mother, and their individual driving history on these policies separately. Most insurance providers base the insurance rates on the driver who develops the highest premium. This is usually the younger motorist. Since your mother has a serious violation and that might cause your premiums to increase as a result.

You may speak with your insurance company to know for sure how much the increase will be if you add your mother with a DUI in your policy.
